Acceptance of Terms

By accessing and using the courier services provided by Phythraxzor, you accept and agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use our services.

Service Description

Phythraxzor provides courier and delivery services for small errands, documents, parcels, and other items within our designated service areas in Victoria, Australia. Our services include same-hour express delivery, same-day service, and next-day priority options as described on phythraxzor.ddd.

Acceptable Use

You must use our website and courier services lawfully and in accordance with these terms. You agree not to:

  • Use the services for any illegal purpose or in violation of Australian law.
  • Submit false, misleading, or inaccurate information for bookings or payments.
  • Interfere with or disrupt our systems, networks, or other users.
  • Attempt to gain unauthorised access to our systems or data.
  • Use the services to send prohibited items as set out in these terms.

We may suspend or terminate your access if we reasonably believe you have breached acceptable use.

User Responsibilities

When using our courier services, you agree to provide accurate and complete information regarding pickup locations, delivery destinations, item descriptions, and contact details. You are responsible for ensuring that items submitted for delivery comply with all applicable laws and regulations.

You must properly package items to prevent damage during transport. Phythraxzor is not responsible for damage resulting from inadequate packaging. Items requiring special handling must be identified at the time of booking.

You warrant that you have the right to send all items submitted for delivery and that such items do not violate any third-party rights or applicable laws.

Prohibited Items

The following items are prohibited from transport via our courier services: illegal substances, hazardous materials, explosives, firearms, perishable food items without proper packaging, live animals, items exceeding our stated size and weight limits, and any items that violate Australian transport regulations.

We reserve the right to refuse service for any item that poses a safety risk or violates these terms. If prohibited items are discovered, we may report them to appropriate authorities.

Pricing and Payment

Prices for our courier services are based on factors including distance, urgency, item size, and special handling requirements. Quotes provided are valid for the date given and may change based on service modifications.

Payment is due at the time of booking for express services unless alternative arrangements have been made for account customers. We accept various payment methods as indicated during the booking process.

All prices are in Australian Dollars and include GST where applicable. Additional fees may apply for services outside our standard operating hours or service areas.

Delivery Timeframes

While we make every effort to meet stated delivery timeframes, all timeframes are estimates and not guarantees unless specifically stated otherwise. Delays may occur due to traffic conditions, weather, recipient availability, or other circumstances beyond our control.

Our service guarantee, where applicable, is subject to the terms specified at the time of booking and may require certain conditions to be met.

Liability and Insurance

Phythraxzor provides basic insurance coverage for items in transit. Our standard liability is limited to the declared value of the item or the amount specified in our standard terms, whichever is lower.

Additional insurance is available upon request for high-value items. Claims for loss or damage must be reported within 48 hours of delivery or scheduled delivery time.

We are not liable for indirect, consequential, or incidental damages arising from delays, loss, or damage to items. Our liability is limited to the value of the delivery service paid or the item value covered by insurance.

Cancellation and Refunds

Cancellations made more than 30 minutes before scheduled pickup receive full refunds. Cancellations made within 30 minutes of pickup may incur a service fee to cover dispatch costs.

If we are unable to complete a delivery due to circumstances within our control, you will receive a full refund or credit toward future services. Refunds for incomplete deliveries due to recipient unavailability or incorrect information provided by the sender are subject to our standard cancellation policy.

Privacy

Your use of our services is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using our services, you consent to the data practices described in our Privacy Policy.

Intellectual Property

All content on phythraxzor.world, including text, graphics, logos, and software, is the property of Phythraxzor and protected by Australian and international intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

Limitation of Liability

To the maximum extent permitted by law, Phythraxzor shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of our services or inability to use our services. In no event shall our total liability exceed the amount paid for the specific service giving rise to the claim.

Nothing in these Terms of Use excludes, restricts, or modifies any rights or remedies you have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or other applicable law that cannot be lawfully excluded. Where our services are supplied to you as a consumer, you may have statutory consumer guarantees (including as to acceptable quality and fitness for purpose) that cannot be excluded by agreement.

Indemnification

You agree to indemnify and hold Phythraxzor, its officers, employees, and agents harmless from any claims, damages, losses, or expenses arising from your use of our services, violation of these terms, or violation of any rights of third parties.

Dispute Resolution

We encourage you to contact our customer service team first to resolve any dispute arising from these terms or our services. Most issues can be resolved through direct communication.

  • Contact us in writing (email or post) with a clear description of the dispute and the outcome you seek.
  • We will acknowledge your complaint and respond within a reasonable time (typically within 14 business days).
  • If we cannot resolve the matter, you may refer the dispute to an alternative dispute resolution scheme or pursue your rights under Australian Consumer Law (including through the relevant state or territory consumer agency or court).

Applicable Law

These Terms of Use are governed by the laws of the State of Victoria, Australia, and the Commonwealth of Australia. The Australian Consumer Law applies to the supply of our services to consumers in Australia and gives you rights that cannot be excluded or limited by these terms. Any legal proceedings shall be brought in the courts of Victoria or the Commonwealth of Australia, as applicable.

Modifications to Terms

We reserve the right to modify these Terms of Use at any time. Changes will be posted on phythraxzor.world with an updated effective date. Your continued use of our services after changes constitutes acceptance of the modified terms.

Severability

If any provision of these terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms of Use shall otherwise remain in full force and effect.
